This is an appeal from an action by Lillian Deter, plaintiff below, against Cloid Deter for separate maintenance. At the conclusion of plaintiffs case, upon trial to jury, the court dismissed the complaint on the ground that plaintiff had failed to establish a prima facie case that there was a common-law marriage between the parties. Plaintiff assigns this ruling as error. We agree.
